These Terms & Conditions govern the use of the SMB Booster website and the website design services provided by SMB Booster ("we", "us", "our"). By purchasing or using our services, you agree to be bound by these Terms & Conditions.


1. Services Provided

SMB Booster provides subscription-based website design and development services for small and medium-sized businesses. Our services include website creation, ongoing updates, maintenance, and additional features as outlined in your selected package.


2. Subscription Packages

We offer three subscription tiers. Each package includes specific features, page limits, and monthly update allowances:

2.1 Standard System - £25/month

Initial Website Build Includes:

Up to 15 pages included in the initial build

Custom website design optimised for conversion

Lead-generating quote forms

Tap-to-call button

Service pages and areas covered pages

Google My Business map & page connection

Secure fast hosting & SSL certificate

Leave a review button + QR code

Fully SEO optimised

Access to website editor

Monthly Updates & Maintenance:

Up to 1 hour per calendar month for content updates, edits, or alterations

Includes: text changes, image swaps, minor layout adjustments, content additions/removals within existing pages

72-hour turnaround for standard updates

2.2 Essentials System - £79/month

Includes everything in Standard System, plus:

Up to 25 pages included in the initial build

CRM system

Chat widget

All-in-one inbox

Linktree-style digital business card with QR code

Mobile app for leads/enquiries

Google Reviews widget

Domain name (if needed)

Fully hands-off management

Monthly Updates & Maintenance:

Up to 1 hour per calendar month for content updates, edits, or alterations

Includes all Standard System updates

48-hour turnaround for standard updates

2.3 Professional System - £147/month

Includes everything in Essentials System, plus:

Up to 45 pages included in the initial build

Auto missed call text-back

Mobile business phone number supplied

AI features including chat widget and automatic replies

One-click review request and year-long marketing campaign

4-5 star only Google Review funnel

Website live AI chat

We reply to all your Google reviews for you

Social media posting of good reviews

Monthly Updates & Maintenance:

Up to 2 hours per calendar month for content updates, edits, or alterations

Includes all Essentials System updates

48-hour turnaround for standard updates

Priority support


3. Additional Work & Extra Services

3.1 What Constitutes Additional Work

The following requests fall outside your monthly update allowance and will be charged separately:

Additional Pages:

Adding new pages beyond your package limit (15, 25, or 45 pages)

Creating complex landing pages or sales funnels

Building new sections that require significant development time

Website Redesigns:

Complete redesign of existing website

Major layout restructuring

Changing the entire theme or design direction

Rebranding implementation across the entire site

Complex Functionality:

Custom forms beyond standard quote forms

E-commerce integration and product setup

Third-party API integrations

Custom calculators or interactive tools

Membership or login areas

Booking systems or calendars

Large-Scale Content Updates:

Bulk content uploads requiring more than your monthly allowance

Restructuring multiple pages simultaneously

Migration of content from external sources

Urgent Rush Work:

Same-day or next-day turnaround requests

Weekend or out-of-hours work

Emergency fixes outside business hours

3.2 Pricing for Additional Work

When your requirements exceed your monthly allowance or package scope, the following rates apply:

Hourly Rates:

Content updates & minor edits: £45 per hour

New page creation: £60 per hour (minimum 1 hour)

Complex functionality & custom development: £75 per hour

Website redesign work: £75 per hour

Rush work (same/next day): £90 per hour

Weekend/out-of-hours work: £100 per hour

Fixed-Price Options:

Single new page: £60 (standard content page)

Complex landing page: £150-250 (depending on requirements)

Minor website redesign (colour/font changes): £200

Partial website redesign (5-10 pages): £500-800

Complete website redesign: £1,200-2,500 (quoted based on scope)

Estimation Process:

You submit a request for additional work

We provide a time estimate and quote within 48 hours

You approve the quote before work commences

Work begins once payment is received or payment terms agreed

3.3 Monthly Update Allowance

Important Notes About Your Monthly Hours:

Monthly update time is allocated on a calendar month basis

Unused hours do not roll over to the following month

Update hours reset on the 1st of each month

Update hours are tracked in 15-minute increments

You will be notified when you approach your monthly limit

What Counts Towards Your Monthly Allowance:

Text and content edits on existing pages

Image replacements

Adding/removing services or content within existing page structure

Price updates

Contact information changes

Minor layout tweaks

Basic troubleshooting and fixes

What Does NOT Count Towards Your Monthly Allowance:

Platform updates and security patches

Server maintenance and hosting management

SSL certificate renewals

Automated backups

Spam comment moderation

Basic technical support and advice


4. Client Responsibilities

You agree to:

Provide all required content, images, branding, and information in a timely manner

Ensure that all content supplied is owned by you or that you have the legal right to use it

Review and approve work promptly to avoid delays

Respond to requests for clarification within 7 days

Provide feedback on draft work within 14 days

SMB Booster is not responsible for delays caused by missing, late, or unclear client-supplied materials. Extended delays may result in project postponement or additional charges.


5. Revisions & Scope Changes

Standard Revisions:

Included within your monthly update allowance

Must be requested within 30 days of work completion

Limited to reasonable adjustments within the original scope

Major Scope Changes:

Requests that significantly change the original design direction, structure, or functionality

Will be treated as new work and quoted separately

May require a new project agreement

Revision Limits:

Standard package: Up to 2 rounds of revisions per page/feature

Essentials package: Up to 3 rounds of revisions per page/feature

Professional package: Up to 4 rounds of revisions per page/feature

Additional revision rounds: £45 per hour


6. Payments & Billing

Subscription Payments:

Monthly subscriptions are billed in advance on the 1st of each month (or anniversary date of signup)

Prices are subject to change with 30 days' written notice

Failure to make payment may result in suspension of services after 7 days

Continued non-payment for 14 days may result in website removal

A £25 late payment fee applies to overdue accounts

Additional Work Payments:

Additional work under £200: Payment required in advance

Additional work over £200: 50% deposit required, balance due on completion

Invoices for additional work are due within 14 days of invoice date

Late payment interest of 3% per month applies to overdue invoices

Refund Policy:

Monthly subscription fees are non-refundable

Deposits for additional work are non-refundable once work has commenced

Refunds for completed work will only be considered in exceptional circumstances


7. Website Ownership, Hosting & Access

While Subscription is Active:

The website is managed and hosted by SMB Booster

You retain ownership of your content and branding

We retain ownership of the website code, design templates, and technical infrastructure

You have access to the website editor (where applicable to your package)

Upon Cancellation:

If cancelled within 12 months: Website files remain property of SMB Booster

If active for 12+ months: Website files can be transferred for a £500 export fee

Export includes: Website files, database, and reasonable assistance with transfer

Export does NOT include: Premium plugins, third-party services, or continued access to our proprietary systems

Website may be taken offline 30 days after cancellation unless alternative arrangements are made

Backups:

We maintain regular backups of your website

Client-requested backup restoration: £45 per instance

Backups are retained for 90 days after cancellation


8. Cancellations & Termination

Your Right to Cancel:

You may cancel your subscription at any time with 30 days' written notice

Notice must be submitted via email to [email protected]

Cancellation takes effect at the end of the current billing period

No refunds for partial months

What Happens Upon Cancellation:

Work will cease at the end of the notice period

No further updates or support will be provided

Website may be taken offline 30 days after final payment

All access to our systems will be removed

Our Right to Terminate:

We reserve the right to terminate services immediately if: Payment is overdue by more than 14 days Terms & Conditions are breached Illegal or inappropriate content is added to the website Abusive behaviour towards our staff

In case of termination by us, no refunds will be provided

Re-activation:

Cancelled accounts can be reactivated within 90 days for no additional fee

After 90 days: £100 reactivation fee applies

After 6 months: Treated as new build, subject to new agreement


9. Support & Response Times

Standard queries: Within 24 business hours

Technical issues: Within 12 business hours

Critical downtime: Within 4 hours (best effort)

Support Scope:

Technical issues with the website

Guidance on using website features

Answering questions about your package

Advice on content updates

NOT Included in Support:

Training on third-party software

Unlimited general business advice

Work on websites not managed by us

Issues caused by client modifications (may be charged at £45/hour)


10. Limitation of Liability

SMB Booster shall not be liable for:

Loss of business, revenue, or profits

Website downtime caused by third-party platforms, hosting providers, or internet service disruptions

Content accuracy, spelling, or grammatical errors provided by the client

Issues caused by client modifications or third-party plugins

Data loss due to client actions or third-party service failures

SEO ranking fluctuations or search engine algorithm changes

Legal issues arising from client-provided content

Maximum Liability: Our total liability shall not exceed the amount paid by you in the previous 3 months of subscription fees.

Insurance: We maintain professional indemnity insurance and public liability insurance as appropriate for our business.


11. Intellectual Property

Your Content:

You retain all rights to content, images, logos, and branding you provide

You grant us licence to use this content for the purpose of building and maintaining your website

Our Work:

We retain intellectual property rights to our code, templates, systems, and proprietary tools

You receive a licence to use the website while your subscription is active

This licence is non-transferable without our written consent

Third-Party Assets:

Some templates, plugins, or tools may be subject to third-party licences

We do not guarantee continued availability of third-party services


12. Content & Legal Compliance

Your Responsibilities:

Ensure all content complies with UK law

Obtain necessary permissions for use of images, text, and other materials

Comply with GDPR and data protection regulations

Maintain appropriate privacy policies and cookie notices

Do not upload illegal, defamatory, or inappropriate content

Our Rights:

We reserve the right to remove any content we deem inappropriate

We may suspend services if illegal content is discovered

We will cooperate with law enforcement if required


13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:

Acts of God, natural disasters

Internet or telecommunications failures

Government actions or restrictions

Pandemics or public health emergencies

Cyberattacks not caused by our negligence


14. Data Protection & Privacy

We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for full details.

Your Data Rights:

Access your data held by us

Request correction of inaccurate data

Request deletion of your data (subject to legal obligations)


15. Dispute Resolution

Informal Resolution:

Any disputes should first be raised via email to [your email]

We commit to responding within 5 business days

We will attempt to resolve the matter amicably within 30 days

Formal Resolution:

If informal resolution fails, disputes will be handled in accordance with UK law

Both parties agree to mediation before pursuing legal action


16. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Changes will be communicated via:

Notice on your client dashboard

Update on our website

Your Options:

Continued use of our services constitutes acceptance of revised terms

If you disagree with changes, you may cancel within 30 days without penalty

Notice Period:

Material changes to pricing or services: 30 days' notice

Minor administrative changes: 7 days' notice


17. General Provisions

Assignment:

You may not transfer or assign your subscription without our written consent

We may transfer our rights and obligations with notice to you

Severability:

If any provision is found to be unenforceable, the remainder remains in full effect

Entire Agreement:

These Terms & Conditions constitute the entire agreement between parties

Any verbal agreements or promises not documented here are not binding

Waiver:

Our failure to enforce any right does not constitute a waiver of that right
